Professor Kara W. Swanson's article Race and Selective Legal Memory: Reflections on Invention of a Slave sheds light on historical discrimination in patent law and the role of memory in our very framing of the law. It also asks us to consider whom intellectual property law recognizes, what intellectual property law should protect, and how conceptions of race and community influence judgments in administrative forums and courts.
